T&Cs

 

1.  The Promoter 

1.1 The promoter of this competition is Guzman y Gomez Limited (ABN 25 125 554 743) of 64–76 Kippax Street, Surry Hills NSW 2010, Australia (the “Promoter”, “GYG”, “we”, “us” or “our”). 

1.2 Any queries about this competition can be directed to the Promoter via direct message on the official GYG account on which the competition is run, or via social.media@guzmanygomez.com. 

2.  Agreement to these terms 

2.1 These Terms and Conditions (“Terms”) govern the competition described below (the “Competition”). By entering the Competition, each entrant accepts and agrees to be bound by these Terms. 

2.2 Any instructions, requirements or information set out in the Competition post, caption or accompanying creative (including how to enter) form part of these Terms. To the extent of any inconsistency, these Terms prevail. 

2.3 The Competition is a game of skill. Chance plays no part in determining the winners. 

3.  Competition period 

3.1 The Competition opens at the time the Competition post is published on 24 September 2026 and closes at 11:59pm AEST on 29 September 2026 (the “Competition Period”). 

3.2 Entries received before the Competition opens or after it closes will not be accepted. The Promoter’s systems are the official record of the time an entry is received. 

4.  Who can enter 

4.1 Entry is open only to individuals who, at the time of entry: 

(a) are aged 18 years or over; and 

(b) are residents of Australia. 

4.2 The following people are not eligible to enter or win: 

(a) directors, officers, employees and contractors of the Promoter and of its related bodies corporate, franchisees, agencies and suppliers associated with this Competition; and 

(b) the immediate family members (spouse, de facto partner, parent, child or sibling) of any person listed in clause 4.2(a). 

4.3 Entrants must have a valid, public account on the relevant social media platform and must comply with that platform’s own terms of use. Entries from private accounts that cannot be verified may be disqualified. 

4.4 If an entrant is found to be ineligible, the Promoter may disqualify the entry and, where a prize has already been awarded, require the prize to be returned or its value repaid. 

5.  How to enter 

5.1 To enter, during the Competition Period an entrant must: 

(a) locate the official GYG Competition post on [Instagram, Facebook and TikTok]; and 

(b) post a comment on that Competition post describing the wildest thing they have ever done for GYG. Entrants are encouraged (but not required) to include photos or other supporting material where the platform allows. 

5.2 Each comment that meets these Terms constitutes one entry. An individual may submit more than one entry, provided each entry is a genuinely different response. The Promoter may treat repeated, duplicated or spam-like comments as a single entry or as invalid. 

5.3 Entry is free. No purchase is necessary to enter or win. Any standard data or internet charges from the entrant’s carrier or platform are the entrant’s responsibility. 

5.4 Entries must be the entrant’s own original content. Entries must not be automated, generated by a third party on the entrant’s behalf in a way that misrepresents authorship, or entered through any means that subvert the entry process. 

6.  Entry content standards 

6.1 Entries (including any images) must not: 

(a) be defamatory, obscene, indecent, hateful, discriminatory, harassing or otherwise unlawful; 

(b) depict or promote unsafe, dangerous or illegal conduct; 

(c) infringe the intellectual property, privacy or other rights of any person; or 

(d) contain the personal information of any other person without their consent. 

6.2 The Promoter may, at its discretion and without notice, remove, hide or refuse to consider any entry that it reasonably considers breaches clause 6.1 or these Terms, or is otherwise inappropriate. Removal of a comment by a platform for any reason may render an entry invalid. 

7.  The prizes 

7.1 There are five (5) prizes. Each prize is a GYG gift card to the value of AUD $250. 

7.2 The total prize pool is AUD $1,250 (five prizes × $250). 

7.3 Each winner will receive one (1) prize. The prize is awarded to the account holder of the winning entry. 

7.4 Prizes are not transferable or exchangeable and cannot be redeemed for cash. Prizes cannot be sold or auctioned. 

7.5 The GYG gift card is subject to the GYG Gift Card Terms of Use (available at https://www.guzmanygomez.com.au/terms-conditions/), including any expiry date and conditions of use in force at the time of issue. The gift card is valid for 3 years after the date of issue. 

7.6 If a specified prize becomes unavailable for reasons beyond the Promoter’s reasonable control, the Promoter may substitute a prize of equal or greater value, subject to any written directions from a relevant authority. 

8.  How winners are chosen 

8.1 This is a game of skill. A panel of judges appointed by the Promoter will review all valid entries and select the five (5) winners it considers the best, judged on: 

(a) originality; 

(b) creativity; and 

(c) demonstrated GYG fandom (how genuinely “all in” for GYG the entry shows the entrant to be). 

8.2 Each entry will be individually judged on its merit. The judges’ decision is final and binding, and no correspondence will be entered into, except where required by law. 

8.3 Judging will take place on or around 30/09/2026 at 64 Kippax St, Surry Hills NSW 2010, Australia. 

8.4 In the event of a tie or dispute between comparable entries, the judges will conduct a further assessment of the tied entries against the criteria in clause 8.1 to determine the winner(s). 

9.  Winner notification and claiming prizes 

9.1 The winners will be notified within 2 business days of the judging via a post on Instagram, Facebook and TikTok, a winning comment and a direct message from the official GYG account. 

9.2 To claim a prize, a winner must respond to the Promoter and provide the details reasonably required to verify eligibility and deliver the prize (which may include the winner’s full name, date of birth, State/Territory of residence and a delivery email or address) within (14) days of being notified. 

9.3 The Promoter may require a winner to provide proof of identity, proof of age and proof of residency, and to sign a declaration or release, before a prize is awarded. A winner who cannot establish eligibility to the Promoter’s reasonable satisfaction forfeits the prize. 

9.4 Prizes will be delivered by post to the winner within [14] days after the winner’s eligibility and claim details are confirmed. 

10.  Unclaimed or forfeited prizes 

10.1 If a winner cannot be contacted, does not respond or claim their prize within the time required, is found to be ineligible, or forfeits their prize, the Promoter reserves the right (subject to any applicable law and to any written directions of a relevant authority) to award that prize to the next best eligible entry as determined by the judges. 

10.2 Any re-determination of a winner will use the same judging criteria set out in clause 8.1. 

11.  Entrant warranties and licence to use entries 

11.1 By entering, each entrant warrants that their entry is their own original work, that they own or control all rights in it, and that it does not infringe the rights of any third party or breach any law. 

11.2 Each entrant grants the Promoter a non-exclusive, worldwide, royalty-free, perpetual and irrevocable licence to use, reproduce, edit, adapt, publish and communicate their entry (in whole or in part, including the entrant’s social media handle) for the purposes of conducting, promoting and administering this and future GYG promotions, and for GYG’s marketing and publicity, in any media. 

11.3 To the extent permitted by law, each entrant consents to the use of their entry as described in clause 11.2 without further reference, attribution, notification or compensation, and consents to any act or omission that would otherwise infringe any moral rights they may have in the entry in connection with such use. 

11.4 Where an entry contains the image, likeness or personal information of any other identifiable person, the entrant warrants that they have obtained that person’s consent to the entry and to its use under these Terms. 

12.  Winner publicity 

12.1 As a condition of accepting a prize, each winner agrees that the Promoter may publish and use the winner’s first name, social media handle, State/Territory of residence and winning entry for promotional and administrative purposes without further compensation, except where prohibited by law. 

12.2 A winner may be asked (but is not obliged) to participate in reasonable promotional activity in connection with the Competition. 

13.  Privacy 

13.1 The Promoter collects entrants’ personal information to conduct the Competition, including to run the promotion, verify eligibility, and notify and deliver prizes to winners. If this information is not provided, the Promoter may be unable to include the individual in the Competition or award a prize. 

13.2 The Promoter may disclose personal information to its related bodies corporate, and to agents, contractors and service providers who assist in conducting the Competition or delivering prizes, and to relevant authorities where required. 

13.3 The Promoter handles personal information in accordance with the Privacy Act 1988 (Cth) and its Privacy Policy, available at  https://www.guzmanygomez.com.au/privacy-policy/, which explains how an individual may access or correct their personal information or make a complaint. 

14.  Liability 

14.1 Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by law (including the Australian Consumer Law) that cannot lawfully be excluded or limited (“Non-Excludable Guarantees”). 

14.2 Subject to clause 14.1, and to the extent permitted by law, the Promoter (and its related bodies corporate, officers, employees, agents and contractors) is not liable for any loss, damage, cost or expense (including indirect or consequential loss) suffered or incurred in connection with the Competition or any prize, except to the extent caused by the Promoter’s negligence, including: 

(a) any technical failure, error, omission, interruption, delay, or failure of any social media platform, website, network or system; 

(b) any entry that is lost, late, incomplete, corrupted, delayed, misdirected, or not received or recorded for any reason; 

(c) any theft, loss or misuse of a prize after it has been delivered; or 

(d) any personal injury or property damage, arising from participation in the Competition or use of a prize. 

14.3 Except for any liability that cannot be excluded by law, the Promoter’s maximum liability to any entrant is limited, at the Promoter’s option, to resupplying the prize or paying the cost of resupplying the prize. 

15.  General 

15.1 The Promoter may, in its reasonable discretion, disqualify any entrant who it reasonably believes has tampered with the entry process, breached these Terms, engaged in fraudulent, misleading or unlawful conduct, or acted in a way that damages the reputation of the Promoter. 

15.2 If the Competition cannot run as planned for reasons beyond the Promoter’s reasonable control (including infection by computer virus, network failure, tampering, fraud, or any other cause that corrupts or affects the administration, security, fairness or proper conduct of the Competition), the Promoter reserves the right, subject to any applicable law and any written directions of a relevant authority, to modify, suspend, cancel or terminate the Competition, or to disqualify affected entries. 

15.3 The Promoter may amend these Terms where reasonably necessary, including to correct errors or to comply with any applicable law or platform requirement. Any updated Terms will apply from the time they are published. 

15.4 The Promoter’s failure to enforce any of its rights under these Terms does not constitute a waiver of those rights. 

15.5 If any provision of these Terms is found to be invalid or unenforceable, it is to be read down or severed to the minimum extent necessary, and the remaining provisions continue in full force. 

15.6 These Terms are governed by the laws of New South Wales, Australia, and each entrant submits to the non-exclusive jurisdiction of the courts of that State. 

16.  Social media platform release 

16.1 This Competition is in no way sponsored, endorsed, administered by, or associated with Meta Platforms, Inc. (Instagram or Facebook), TikTok, or any other social media platform on which it is run. 

16.2 Entrants understand that they are providing their information to the Promoter and not to any social media platform, and release each relevant platform from all liability in connection with the Competition. Any questions, comments or complaints about the Competition must be directed to the Promoter, not to the platform.
